These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and QUICK VISION STUDIOS YAZILIM TASARIM BİLİŞİM İÇ VE DIŞ TİCARET LİMİTED ŞİRKETİ ("QUVIAI", "Company", "we", "us", "our"), registered in Ankara, Turkey, regarding your use of the QUVIAI platform, including the website at quvi.ai and all associated mobile applications, APIs, and services (collectively, the "Service").
By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.
You must be at least 13 years of age to use the Service.
If you are a resident of the European Union, you must be at least 16 years of age, or have obtained verifiable parental or guardian consent.
By using the Service, you represent and warrant that you meet the applicable age requirements and have the legal capacity to enter into these Terms.
If you are under 18, your parent or legal guardian must review and agree to these Terms on your behalf.
QUVIAI is an AI-powered creative platform ("SaaS") that enables users to generate images, 3D objects, videos, music, and other visual and multimedia content using artificial intelligence models. The Service operates on a freemium model:
Free Tier: Access to limited daily credits and core features at no charge.
Paid Subscriptions: Enhanced features, higher credit limits, and additional capabilities via subscription plans.
Booster Packs: One-time credit top-ups available to active subscribers.
Corporate Plans: Team-based subscription options for organizations.
4.1 Registration: You must create an account to access most features. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.
4.2 Account Security: You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at [email protected] if you suspect unauthorized access to your account.
4.3 Account Termination: We reserve the right to suspend or terminate your account at any time for violation of these Terms, without prior notice, and without liability to you.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
Generate, upload, or distribute content that is illegal, harmful, defamatory, obscene, or infringes third-party rights.
Attempt to generate content depicting child sexual abuse material (CSAM) or any content sexualizing minors. Such attempts will result in immediate and permanent account termination and may be reported to relevant authorities.
Generate content that depicts, defames, threatens, harasses, or is otherwise harmful toward any real individual, public figure, private person, organization, or company, including realistic depictions of real people in false, misleading, or damaging contexts.
Generate content intended to impersonate, deceive, or defraud any person or entity.
Use the Service to harass, threaten, or intimidate others.
Reverse engineer, decompile, or attempt to extract source code from the Service.
Use automated tools, bots, or scripts to access the Service in ways that circumvent rate limits or terms.
Resell, sublicense, or commercially redistribute AI-generated outputs in violation of applicable laws or these Terms.
Attempt to circumvent content moderation systems.
Use the Service to train competing AI models without explicit written permission.
Violate any applicable local, national, or international law or regulation.
6.1 Nature of AI Outputs: The Service uses artificial intelligence models to generate content. AI-generated outputs are inherently probabilistic and may be inaccurate, incomplete, biased, or unexpected. We do not guarantee that outputs will meet your specific expectations or quality standards.
6.2 Model Quality: The quality, accuracy, and style of AI-generated content depends on the underlying models. Model quality and output characteristics are subject to change without notice. The freemium model allows you to test the service before committing to a paid plan, and we encourage you to do so before subscribing.
6.3 Content Responsibility: You are solely responsible for how you use AI-generated content. You must review all outputs before any commercial or public use. We are not liable for any damages arising from your use or misuse of AI-generated content.
6.4 Content Moderation: We employ automated content moderation systems that actively monitor generation requests. We reserve the right to block, remove, or report any content that violates these Terms or applicable law.
6.5 Platform Scope: QUVIAI does not provide any public gallery, social sharing, or community features. All generated content remains private to the generating user's account. This Policy applies solely to content generated within the platform, regardless of whether it is ever published externally.
6.6 Enforcement and Account Termination for Policy Violations: If our automated systems or manual review detect that a user has generated content that violates Section 5 of these Terms, the account will be permanently suspended without prior notice. No refund will be issued for any remaining subscription period, unused credits, or booster packs, regardless of payment method or platform. Violations involving CSAM or credible threats of violence may be reported to relevant law enforcement authorities. QUVIAI's decision to suspend an account for policy violations is final.
7.1 Our Intellectual Property: All rights, title, and interest in the Service — including software, design, trademarks, logos, and underlying AI models — are owned by QUVIAI or its licensors. Nothing in these Terms grants you any rights to our intellectual property except as expressly stated.
7.2 Free Tier Content: If you are a free (non-paying) user, you grant QUVIAI a worldwide, royalty-free, non-exclusive, perpetual license to use, reproduce, modify, and display content generated through your use of the Service for QUVIAI's own business purposes, including model training, marketing, and service improvement. We will not claim authorship over such content.
7.3 Paid Subscriber Content: If you are an active paid subscriber (including corporate plan members), all AI-generated content produced during your active subscription period belongs exclusively to you. QUVIAI does not claim any license or ownership over such content and will not use it for commercial purposes without your consent.
7.4 User-Uploaded Content: You retain ownership of any content you upload to the Service. By uploading content, you grant QUVIAI a limited license to process and store that content solely to provide the Service.
8.1 Uptime: We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, infrastructure issues, or events beyond our control.
8.2 Technical Failures: In the event of a technical failure that results in a failed generation where credits were deducted, those credits will be automatically refunded to your account. If an automatic refund does not occur within a reasonable time, please contact [email protected].
8.3 Third-Party Dependencies: The Service relies on third-party AI model providers, cloud infrastructure, and payment processors. We are not liable for service interruptions or degradation caused by third-party failures.
8.4 Force Majeure: We are not liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, cyberattacks, pandemics, government actions, or internet outages.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
IN NO EVENT SHALL QUVIAI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless QUVIAI and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:
Your use of the Service in violation of these Terms.
Your violation of any applicable law or third-party rights.
Content you generate, upload, or transmit through the Service.
The Service may contain links to third-party websites or integrate with third-party services. We do not endorse and are not responsible for the content, policies, or practices of third-party services.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of material changes to these Terms via email or in-app notification. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
13.1 Governing Law: These Terms are governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict of law principles.
13.2 Dispute Resolution: In the event of a dispute, the parties agree to first attempt resolution through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the rules of the International Chamber of Commerce (ICC), with the seat of arbitration in Ankara, Turkey, conducted in English or Turkish.
13.3 Consumer Rights: Nothing in these Terms limits any consumer rights you may have under applicable mandatory local laws.
Entire Agreement: These Terms, together with the Privacy Policy and Terms of Paid Service, constitute the entire agreement between you and QUVIAI.
Severability: If any provision is found unenforceable, the remaining provisions continue in full force.
Waiver: Failure to enforce any provision shall not constitute a waiver.
Assignment: You may not assign your rights under these Terms without our written consent.
