Terms of Service

1. Introduction and Acceptance

These Terms of Service ("Terms") form a legally binding agreement between you ("User", "you") and QUICK VISION STUDIOS YAZILIM TASARIM BİLİŞİM İÇ VE DIŞ TİCARET LİMİTED ŞİRKETİ ("Quick Vision Studios", "we", "us", "our"), registered in Ankara, Turkey, regarding your use of Ombravel, including its mobile applications and related services (the "Service").

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Eligibility and Age Requirements

You must be at least 13 years old to use the Service. If you are in the European Union, you must be at least 16, or have verifiable parental or guardian consent. If you are under 18, your parent or legal guardian must review and agree to these Terms on your behalf. By using the Service you represent that you meet these requirements and have the legal capacity to accept these Terms.

3. Description of Service

Ombravel is an AI-powered service that lets you generate short videos (with audio) from text prompts and images. The Service operates on a credit model: new accounts receive a one-time bonus of free credits, and additional credits can be purchased as one-time packs. Details of paid credits are set out in our Terms of Paid Service.

4. User Accounts

4.1 Registration. You must create an account to use the Service. You agree to provide accurate information and keep it up to date.

4.2 Account Security. You are responsible for your account credentials and for all activity under your account. Notify us at [email protected] if you suspect unauthorized access.

4.3 Account Deletion. You may delete your account at any time from within the App or by requesting deletion via our Account Deletion page. Deletion is immediate and irreversible.

4.4 Termination by us. We may suspend or terminate your account for violation of these Terms, without prior notice where warranted, and without liability to you.

5. Acceptable Use

You agree to use the Service only for lawful purposes. You agree not to:

• Generate, upload, or distribute content that is illegal, harmful, defamatory, obscene, or infringes third-party rights.
• Attempt to generate child sexual abuse material (CSAM) or any content sexualizing minors. Such attempts result in immediate, permanent account termination and may be reported to authorities.
• Generate content that depicts, defames, threatens, harasses, or is harmful toward any real person, public figure, organization, or company — including realistic depictions of real people in false, misleading, or damaging contexts, or without their consent.
• Generate content intended to impersonate, deceive, or defraud any person or entity.
• Create non-consensual intimate imagery of any real person.
• Attempt to circumvent content moderation systems.
• Reverse engineer, decompile, or extract source code from the Service.
• Use bots, scripts, or automated tools to bypass rate limits or these Terms.
• Use the Service to train competing AI models without our written permission.
• Violate any applicable local, national, or international law.

You are solely responsible for the content you generate and for how you use it. While we prohibit the uses above and moderate content, we cannot guarantee that every prohibited attempt is prevented; responsibility for your inputs and outputs rests with you.

6. AI-Generated Content

6.1 Nature of AI outputs. Outputs are produced by AI models and are inherently probabilistic. They may be inaccurate, incomplete, biased, or unexpected. We do not guarantee any particular quality or result.

6.2 Your responsibility. You must review all outputs before any public or commercial use. We are not liable for damages arising from your use or misuse of AI-generated content.

6.3 Moderation. We employ automated content moderation on both inputs and outputs. We may block, remove, or report content that violates these Terms or the law.

6.4 Private by design. The Service does not provide any public gallery, social feed, or sharing features. Content you generate remains private to your account.

6.5 Enforcement. If our systems or review detect a violation of Section 5, your account may be permanently suspended without prior notice, with no refund of any remaining credits. Violations involving CSAM or credible threats may be reported to law enforcement. Our decision is final.

7. Intellectual Property and Content Ownership

7.1 Our IP. All rights in the Service — software, design, trademarks, logos, and underlying models — belong to Quick Vision Studios or its licensors.

7.2 Your content. You own the content you create with the Service, and you may use it, including commercially, subject to these Terms and applicable law. We do not claim ownership of your generated content and we do not use it to train our models.

7.3 Uploaded content. You retain ownership of content you upload. By uploading, you grant us a limited license to process and store that content solely to provide the Service to you.

8. Service Availability

8.1 We aim for high availability but do not guarantee uninterrupted access.

8.2 Failed generations. If a generation fails after credits were deducted, those credits are automatically refunded to your balance. If an automatic refund does not occur, contact [email protected].

8.3 Third-party dependencies. The Service relies on cloud infrastructure and payment processors. We are not liable for interruptions caused by third-party failures.

8.4 Force majeure. We are not liable for failures caused by events beyond our reasonable control.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Quick Vision Studios and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms or the law, or content you generate, upload, or transmit.

11. Modifications

We may modify, suspend, or discontinue any part of the Service. We will give reasonable notice of material changes to these Terms via email or in-app notice. Continued use after changes take effect constitutes acceptance.

12. Governing Law and Disputes

12.1 These Terms are governed by the laws of the Republic of Turkey, without regard to conflict-of-law rules.

12.2 Disputes shall first be addressed through good-faith negotiation. If unresolved within 30 days, they shall be submitted to binding arbitration under the ICC rules, seated in Ankara, Turkey, conducted in English or Turkish.

12.3 Nothing here limits mandatory consumer rights you may have under your local law.

13. Miscellaneous

These Terms, together with the Privacy Policy and Terms of Paid Service, are the entire agreement between you and us. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights without our written consent.
